Agreeing to these terms
These Terms of Service (“Terms”) are an agreement between you and Soundtracked (“we,” “us”). By creating an account or using the Soundtracked app, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use Soundtracked.
Who can use Soundtracked
You must be at least 13 years old to use Soundtracked. If you're under the age of majority where you live, you need a parent or guardian's permission. You can have one personal account, and you're responsible for keeping your login secure and for everything that happens on your account.
Your content
You own the ratings, reviews, comments, mixtapes, photos and other content you post (“your content”). To run the app, you give us a worldwide, non-exclusive, royalty-free license to store, display and share your content inside Soundtracked, for example showing your review on an album page or in your followers' feeds. This license ends when you delete the content or your account, except for content others have already interacted with in ways we can't reasonably undo, and reports under review.
Only post content you have the right to share. Don't post full song lyrics or other people's copyrighted work.
Community rules
Soundtracked is for honest opinions about music. Strong opinions and swearing are fine. These are not:
- Slurs, hate speech, or attacks on people based on race, ethnicity, religion, gender, gender identity, sexual orientation, disability or similar traits.
- Harassment, bullying, threats, or telling anyone to hurt themselves.
- Sexual content involving minors, or sexually explicit images.
- Pretending to be someone else, including artists, or misleading others about who you are.
- Spam, scams, fake accounts, or using bots or scripts to post, follow or like.
- Sharing someone else's private information.
- Anything illegal, or trying to break, overload or get around the security of the app.
Soundtracked automatically blocks slurs and hate speech. You can report any review, comment, mixtape or profile, and block anyone. We review reports and may remove content or suspend or delete accounts that break these rules, with or without notice.
Music information
Song, album and artist information and cover art come from Apple. Soundtracked isn't affiliated with, endorsed by or sponsored by Apple or any artist or record label. Apple Music is a trademark of Apple Inc. Soundtracked doesn't play music; connecting Apple Music only lets the app show your recently played songs and albums.
Our app
The Soundtracked name, logo, design and software belong to us. You may use the app for personal, non-commercial purposes. Don't copy, modify, reverse engineer or resell it, or collect other users' information from it.
We're always improving Soundtracked, so features may change, and we may pause or stop parts of the service.
Ending your account
You can stop using Soundtracked and delete your account at any time in Profile → Settings → Delete Account. We may suspend or end your account if you break these Terms or if we're required to by law. Sections of these Terms that by their nature should last, such as the disclaimers and limits on liability, continue to apply after your account ends.
Disclaimers
Soundtracked is provided “as is” and “as available.” To the fullest extent allowed by law, we don't make warranties of any kind, including that the app will always be available, error-free or secure. Reviews and other content are the opinions of the users who post them, not of Soundtracked.
Limits on liability
To the fullest extent allowed by law, Soundtracked won't be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, arising from your use of the app. Our total liability for any claim relating to Soundtracked is limited to $50 USD. Some places don't allow these limits, so they may not apply to you.
Apple App Store terms
If you downloaded Soundtracked from the Apple App Store, these Terms are between you and Soundtracked only, not Apple. Apple isn't responsible for the app, its content, maintenance, support, or any claims relating to it, including product liability, legal compliance or intellectual property claims. If the app fails to meet any applicable warranty, you may notify Apple for a refund of any purchase price (Soundtracked is free), and Apple has no other warranty obligation. You must follow Apple's Media Services Terms when using the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Governing law
These Terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. If any part of these Terms can't be enforced, the rest still applies.
Changes to these terms
We may update these Terms. If the changes are meaningful, we'll update the date at the top of this page and let you know in the app. Continuing to use Soundtracked after an update means you accept the new Terms.
